Liability Release for Use of Club Equipment

As an EDHWM member in good standing, I may utilize equipment owned and maintained by EDHWM. By agreeing to the Terms of the Liability Release for Use of Club Equipment at the time of applying for membership or renewing my membership, I agree to the following conditions of use:

a. My Responsibility. I am aware my use of EDHWM equipment may involve risks which could result in damage, loss, expense or injury while in my possession. Accordingly, I assume full responsibility for obtaining instruction concerning the safe use and operation of any EDHWM equipment prior to use.

b. Waiver of Claims. I hereby waive any and all future claims of any nature I or my heirs may have against EDHWM and its representative(s) from liability for any loss, damage, expense or injury due to any cause whatever, including EDHWM negligence.

c. Hold Harmless & Indemnify Claims of Others. I assume personal and financial responsibility for any injury or property damage to third parties arising from the use of EDHWM equipment in my possession. I specifically indemnify and hold harmless EDHWM and its representative(s) for any injury or financial responsibility arising from use of EDHWM equipment by others during the period of time the equipment is in my possession.

d. Condition of Equipment. I am responsible for cleaning and returning equipment in the same condition that I found it in when I picked it up. If I damage equipment I agree to pay for the repair or replacement value of the equipment.

e. Limit on Equipment. I understand that no member may check out more than one of the same type of equipment simultaneously; for example, two bottlers at the same time. I also understand that I cannot reserve equipment in advance and must return equipment by the time requested by the equipment custodian.

f. Use of Equipment. I understand that I am prohibited from loaning or allowing non-members to use club equipment.

g. Club Equipment and Guidelines for Use. I understand that I can find the current year’s Equipment List and Guidelines for Use on the club’s website, which gives an itemized list of club equipment available for club members to use, as well as additional guidelines which I agree to follow.

h. Loss of Right to Use. I understand that I will lose my status as a member in good standing and the right to use equipment if I do not adhere to all the guidelines for equipment use outlined in the Liability Release for Use of Club Equipment and the Guidelines for Equipment Use on the Equipment List.
